Arbitration agreements are put in writing so that everyone involved can harness the rules that they’ll be expected to follow. Then, with the benefit of knowledgeable legal advice from their prospective family lawyers, the parties' cases are presented to their arbitrator. Eventually, not unlike a traditional presiding judge, the arbitrator will render a binding decision on each of the family law issues. Ultimately, the arbitrator’s ruling is absolute and effective, barring an appeal.
What Is Arbitration Procedure
Arbitration has some similarities to the court process since each party can call witnesses and present evidence, and arbitrators can make enforceable orders. However, it is less formal than a court proceeding thereby significantly reducing your legal fees that would otherwise be consumed by filling and filling court forms. Arbitration frequently achieves results much faster than the public court forum. Further advantages arise from the exceptional control that the parties can exercise over the arbitration process at all times. For example, in the public courts, the judge deciding your case is assigned and you have no influence over that determination. In contrast, parties can choose their decision-maker after careful analysis of the backgrounds, influences, and ideologies of all available arbitrators. Another compelling reason to choose arbitration is the undeniable level of privacy that the arbitration process is known for. The public court is required to publicize all cases, making the private lives of litigants, accessible to everybody, forever. Alternatively, arbitrations are private and confidential. In other words, your children, associates, or bosses will never be able to read about the details of your matter to the extent they could if your case is tried in the public court system. Therefore, arbitration is regarded by many, as the best way to resolve the sensitive issues inherent in family law disputes.
